—   Hill v. Harrison, plaintiff sued for 3l. 18s. 6d. the price of three hams and a quantity of manure. The case came on for hearing at the last court and was adjourned to enable defendant to produce evidence of payment for the hams.  He now called Mr. G. Mundy, of Harting, who deposed that he sold certain hams corresponding with those in question to defendant, and directed them to be left at plaintiff’s house, the Spread Eagle, Liss. Defendant produced the bills for these hams duly receipted by Mr. Mundy. Plaintiff stated that the hams for which he sued were not those sent by Mr. Mundy, but others which he had purchased from other quarters, and called Thomas Bennett, a carrier, who deposed to having carried hams for plaintiff on several occasions. The judge, after a rigid scrutiny of plaintiff’s book, and a comparison of dates, struck out all the hams and gave judgment for the manure. See also 14-May1863
