COUNTY COURT, Saturday last, before C. J. Gale, Esq., Judge.
— A HORSE CASE.—John Lever, of Harting sued Peter Port, of Chichester, for breach of warranty in the sale of a horse. Defendant did not appear. Plaintiff deposed that he bought a horse of defendant for £20, under a warranty of soundness. The horse turned out brocken-winded. He sold it in Petersfield market by auction, and it fetched fourteen guineas; the expenses were 14s., besides a journey to Chichester. Judgment for £7, in a week—Mr. Albery, of Midhurst for the plaintiff.
— WHO SUPPLIED THE HAMS?—Hill v. Harrison. —This was a suit for £3 18s. 6d., for three hams, a quantity of manure, &c. Defendant objected to the charge of 12s. for the manure, as being full double its value, but was contradicted in this by a witness who had loaded the dung. With regard to the hams, the defence was that, although he admitted receiving them through the plaintiff’s agency, they were in fact supplied by Mr. G. Mundy, of Harting, and that he had paid plaintiff for one, and Mr. Mundy for the other two. At the request of defendant, His Honor adjourned the case to enable him to produce Mr. Mundy as a witness.
